Balcones Apartment Terms and Conditions:
All bookings are
accepted subject to the following terms and conditions:-
1.
Definitions:
In these terms and
conditions:
“the Owner” means
Stephen Rosenvinge whose address is 4A Church Square, Harrogate,
HG1 4SP England. Telephone no. 01423 569 698.
“the Client” means any
person whom the Owner contracts with for the use of the Property
and all persons sharing the use of the Property during the
period of letting.
“the Property” means
Apartment B5.1 Los Balcones, Los Arqueros.
2.
No contract comes into existence until the Owner has
accepted a booking in writing.
3.
On the Owner giving written acceptance of a booking, the
Owner agrees to provide the Property for the purposes of holiday
accommodation as described in the Owner’s brochure or website
and price list for the duration of the booking.
4.
The Client agrees to pay a Deposit of 20% of the price
within 7 days of receipt of the Owner’s invoice. Time is of the
essence, and in the event of non-payment the booking is
cancelled.
5.
The Deposit is not returnable in the event of
cancellation.
6.
A security deposit of £150 is payable to cover, for
example (but not limited to), damage to the Property, its
contents, or loss of any keys. This sum shall not limit the
Client’s liability to the Owner in the event of loss. The Owner
will account to the Client for the security deposit and refund
the balance within two weeks after the rental period once the
keys have been safely returned to the Owner and independent
confirmation has been received of no damage.
7.
The Client agrees to pay the balance of the price
together with the security deposit, no later than 8 weeks before
arrival at the Property (or within 7 days of invoice in the case
of a booking less than two months before arrival). Time is of
the essence and the Owner reserves the right to give notice in
writing that the reservation is cancelled in the event of
non-payment.
8.
If the Client cancels after full payment, the security
deposit together with the following percentage of the balance
will be returned, counting from and including the date the Owner
receives notice of cancellation to and including the date of
arrival: 9 days or less 0%; 10-15 days 10%; 16-44 days 25%; 45
or more days 50%.
9.
The Client shall:
(a)
only allow to reside in the Property a maximum of 5
people (unless the Owner gives permission) whose names and
addresses have been supplied to the Owner before the Owner
accepted the booking;
(b)
take good care of the Property and the furniture,
fixtures and fittings and leave it in a clean and tidy
condition. The Owner reserves the right to make a retention
from the security deposit to cover additional cleaning costs if
the Client leaves the Property in an unacceptable condition;
(c)
observe the rules relating to the use of Property and the
pools on the site as contained in the copy of the visitor
notes located in the Property;
(d)
report to the Owner, at his address in clause 1 above,
without delay, defects in the Property or breakdown in the
equipment in the Property.
(e)
respect the peace of the other occupants of the site;
10.
The rental period shall commence at 2:00pm on the first
day and the Client shall vacate the Property by 10:00am on the
day of departure.
11.
Arrivals and departures are on Saturdays unless otherwise
agreed.
12.
In the event of an above average consumption of
electricity (15€ per week), the Owner reserves the right to
deduct the cost of the excess from the security deposit.
13.
Save in the case of death or personal injury the
liability of the Owner shall be limited to the sum paid by the
Client to the Owner for the booking.
14.
The Owner shall not be liable to the Client:
(a)
for any defect or stoppage in the supply of public
services to the Property or in respect of any equipment in the
Property, garden or swimming pools;
(b)
for any loss, damage or injury which is the result of
adverse weather conditions, riot, war, strike or other matters
beyond the control of the Owner.
The Client is strongly
advised to have adequate travel insurance to cover cancellation,
medical expenses and loss or damage to the Client’s possessions.
15.
The contract shall be governed by English law and the
parties submit to the exclusive jurisdiction of the English
courts.
16.
We are not able to accept debit or credit cards in
payment.
